    same with my spouses EAD application. My 485 is pending in NSC. Spouse's EAD pending at TSC, ND July 22 no LUD's yet..
    My spouse's current EAD expires on Sep 26. Hope to get the EAD by then:confused:

    Same with me. 485 pending at NSC, EAD pending at TSC - as per instructions in I765. NO Luds, just silence.

    Santosh_gc, I don't have a problem when you talk about illegals getting ahead of legals etc. But the comment about illegal immigrants bringing corruption into the U.S. was way out of line. It is unfair that illegal immigrants may get ahead of legal immigrants. Let us leave it at that and not speculate on how they might introduce corruption into society. No discussions on how they break the law when they enter the country - that is a bogus argument. Just about every one of us breaks the law every time he/she gets behind the wheel of a car, unless you claim you always drive the speed limit. By your logic, then every immigrant from India can be disallowed as we are exposed to as much corruption in India as there is in Mexico and we might infect the U.S. culture just as much. Bkam's comments didn't add any value to the discussion and were just offensive.

    Keep the argument civil and logical and treat others the way you would like yours to be treated.

    The Ombudsman, I am an IV core member. You may be a contributor to IV but please don't expect me to answer a call from you just because I disagree with you and you would like to argue about it. Keep your arguments logical, don't give us hearsay about what some lawyer told you.

    my 485 app was delivered to NSC on 2nd @ 8.26am..
    my 140 was approved from TSC.... and no reciept or encashed checks yet!

    But are we sure, all our applications will be transferred to TSC? I've heard that the new rule that the apps should be sent to TSC or NSC based on state u live in is gonna take effect only from this week....

    Gurus,

    I have a unique position. couple of weeks back I was told that have fatal cancer and won't live pass 4-6 months. After recovering from initial shock I am wondering if my wife will be able to continue her american dream or she will have to head home after me.

    I have filed 485 with approved 140 back in june, 2007 with PD of March, 2003

    Please help.

    Did this rally on 7th July in San Jose happen? Any updates from folks who were there?

    Just came back, here is my report:

    - There were five Chinese and seven Indian people at the march. It was small fun group.
    - The group was small but the outcome as you will note from my report below was productive
    - Fighnow, who is the Chinese member of mitbbs.com had initiated this 7th July march. Due to short notice we couldn't publicize this event but still it was good to see a bunch of people show up.
    - Fightnow and his friends were fully prepared with big banners and all, with appropriate slogans
    - In the beginning there was some police presence but they left an hour later, I guess because of a small group
    - We carried our placards and banners on the sidewalk and got lot of "honk" support from people driving by.
    - Luckily a Chinese TV station happened to be in the area and interviewed many of us. The station is called KCSN 30, if I remember correctly and this news story will air on Monday evening in Bay area. I will post details about this after hearing from fightnow.
    - The parking is free on weekends.

    What we need to do is:
    - Organize a bigger march on 14th July
    - Organize a similar event in DC if possible to get more mileage
    - Prepare some banners and placards etc.
    - Bring water, it was warm
    - Have fun

    Only if it is too restrictive. this case is pretty straightforward and simple. employee is directly hitting the employer's revenues.

    I am not hitting on employers revenues, infact employer made money since two yrs because of me. The reason is, employer never got this project for me. It never had any business either with PF or with the client earlier. It was only because of my contact with the PF i got the project. i introduced the PF to my employer, have them sign a contract and since these two yrs my employer was able to place 4-5 consultants through the PF i introduced to them. Now tell me, how much my employer would have made because of me or other consultants??? Even after all this, he is being mean to me. these desi companies thirst for money is never ending. whereas consulatnts can never look up for a better life!!!!!!

    Been in the US since 1998, have an EB-2 PD of 2001, have played by the rules all along. Still no GC... And, the dates are going back to 2000 from the new year.. I've lost hopes...

    I'm pretty close to getting clinical depression because of this game played by USCIS, Labor Dept, FBI and my own bad luck.

    SKILL bill, OMNIBUS, etc. comes and goes. IV does seem to be doing things to lobby for the community, but let's face one reality. Like a news article said, no one in congress or senate wants to touch immigration even with a long pole until 2009.

    The US has been very good to me (other than the GC part), more than my home country (India) which is why I'm still here.

    Have invested too much of time in this country to just pack up and go. Just curious if any of you feel this way? How do you handle such depressing feelings?


    Think Positive- that's the first prerequisite for positive things to happen.

    I am quote content with what I have at this point
    8 months ago- everything looked hopeless.
    it seemed I was ages away from being able to change a job or ever get a GC
    but here I am - few weeks ago (fingers crossed) from being able to change jobs on AC21.

    So I thank God for the small mercies and carry on
    Would I like to get a GC? yes. Of course !!!
    But I do pause to thank for what I have and try to make the most of it.
    I am sure you too have lots to be grateful for.

    Chin up- and try not to think about GC so much...that works for me at least...

    You are still thinking about all the job crap and call. Are you some kind of a retard? Holy shit. What more meets the eye man? He might not be around after sometime. Instead of this bullshit, his priority must be to get better and spend time with family and friends. We dont know how things will be after 6 months. What I find retarded is that this crap green card seems to be taking higher position than him getting better.

    To the original poster: Please realize that there is nothing more beautiful than life. Every minute of it is of the essence. Family and loved ones are more important than anything in life. You will not take money, green card or anything after you die. Your wife will be more happy realizing that she spent some fantastic time with you. I wish and pray that you get better. Just junk this immigration shit, go back home, take a second opinion and get better. There is life beyond America and remember that "Jaan hai to jahan hai" (If there is life then you have the world with you). Translation may not be perfect

    I'm seeing lots of folks being greened whose PD is after us. Is it possible that they have PD on their 485 (because I-140 concurrently filed) and so it was picked up by officer? I guess it's not.

    In response to infopass officer's request to expedite, I received letter from USCIS (within a week) . It shows my receipt# correct but shows filing date 10/10/2007. Actually, this is receipt date of case transfer to TSC from NSC.

    The filing date on SR is manually entered by the person opening the SR. It has got nothing to do with your real filing date. All that matters on the SR is your A#.

    I currently have a job offer from the client .

    My previous company has applied in perm as Software engineer , Applications as Job Title and Job Description is PeoplesoftSoft, Peopletools ,SQR

    My client would like to hire me as Peoplesoft Developer. but I am expecting a raise in salary of atleast 30%.

    Would this be a problem ?
    When you say Job description should be more or less same what exactly does that mean. Should it be exactly different or some minor change is ok ?

    Help me out as I have to decide on the offer by weekend.
    Job title - doesnt matter but your job duties or job description matters.
    Your job description should not change from PL//SQL developer to J2EE or something drastically.
    Again as said by Ramba please keep in mind INS have not published any hard lined rules or clarification. But as per my attorney's view INS is lenient on AC21 cases with respect to approval , at the most you may get RFE for job description and latest W2 for salary comparison with 140.
    Finally I am not legal expert , confirm with your lawyer.

    I dont have GC depression just irritation but when other things bother me I just run it out sometimes. Also, there's so much to be done so once you get busy full time and especially weekends so just try and keep yourself occupied and your mind away from the stuff that bothers you. Ofcourse 10 years is a long time and there's no justification for this but hopefully we can solve this mess thru iv so this ugly vb mess is confined to the dustbins of history forever.

    so what is your point? i have no doubts that i can prove point 1, 2 and 3 below... i.e. real business, planned business (with only me as the employee), contracts and orders. i dont think anyone here is talking about a non-bonafide job with a "paper shop" (in your words)...

    what is your point about If business is new, it becomes difficult to show that business can offer full time job to someone at say 60k salary per year? doesnt that sounds like "ability to pay" issue? if yes, that is not an issue at I-485 stage... the yates memo clearly states this...



    The problem with self employment is demonstrate
    1. AC-21 job is in same classification as original labor/I-140
    2. New job is bonafide

    In order to show that the new job is "real", one has to show
    1. The business is real, not just paper shop
    2. Business Plan, Funding to support employees
    3. Any contracts, orders etc

    If business is new, it becomes difficult to show that business can offer full time job to someone at say 60k salary per year. Now, if business has some capital funding or line of credit from bank or some long term contracts, then it is relatively easy to show that business can support employees.

    The burden of proof, in case of RFE, lies on beneficiary.
