I am intrigued by the spirited discussions we have between different categories. Most of the discussions revolves around what is best for "me" which is justified to some extent. Why don't we take a step back and ask this question, what is it that all of our trying to achieve. If the intent is to make sure I get my green card before the other person can, we shouldn't be even thinking about working together and call ourselves a community. We are just wasting our time having discussions and trying to compete among each other. No one initiative will gather steam if that becomes our intent and goal.
In my mind, we have to think of every one of us as one. Yes, there should be classifications, yes there should be qualifications, years of experience, all that in place. However I believe everyone in this community is "qualified" enough to get a green card in a "reasonable" amount of time.
Can we all work together and make that happen? Can we as a group start believing this and supporting IV?
I BELIEVE WE CAN!

very sad to hear your condition. We do have good medical treatment available everywhere. Get the best treatment. I have seen so many people recoved from cancer. Hope you will be the one among them. Don't give up hope and spirit. Hope both you and your family will get GC very soon.
Consult a good attorney what to do immediately.

having been in the US since 2001, losing out my LC/PD to the dot-com bust and finally ending up with a PD of 2006, I second that. PD should be based on number of years of experience or years of stay in the US or amount of taxes paid till now or something like that.
In any case what we WANT is very different from what we usually get from this immigration system and there are bigger more important battles for IV to fight. Look, if there is no retrogression PD almost does not matter!! THATS the right fix. END RETROGRESSION!

If you download the 485 form from the following url and go to page six, it states
"The check or money order should be made payable to theDepartment of Homeland Security"
I believe previously it used to be USCIS. Now what I dont know is if they will accept checks made for USCIS or not.

Although the thread title says "Reimburse the core team" and I know that the core team will not take any money (and do not expect the memebrs to reimburse them) from the fund that we are planning on creating here...Stilll by contributing to this fund we can make sure that core does not have to bear any out of pocket personal expense in future while working on "our" goal.
Lets see how many of us are actually inetested in contributing. Once we have the number we can set a realistic goal and divide amongst ourselves.
For that I suggest we give this thread good two days to develop and check other members responses...
So here is a chance for everyone to contribute to our own goal. Lets keep this going. Who ever is interested pls reply. I will do a final count after 2 days as suggested and take it from there....

Consider the scenario:
Two guys (A and B) come to US in 2005, both do not have MS and experience less than 5 years. Therefore both not elligible for EB2 on 2005. They are from a retrogressed country.
A does MS and joins job in 2007, becomes eligible for EB2 and files GC on 2007.
B joins a job on 2005 that do not need MS and experience and files for EB3.
Till 2010 both of them did not get GC. But B crossed 5 years of experience and from EB3 to EB2. Now B's priority date is 2005, although he was not elligible for EB2 at that time.
Although A was elligible for EB2 in 2007 earlier than B (2010), A is pushed behind B.
SHould it be acceptable to people like A? And there is not one or two pleale like B, thousands arer doing that?
If you see my priority date you will understand I am not saying this for myself. I have a bro and friends who are facing this isssue.
Therefore EB2s who are from mid 2006 onwards will really get pushed back..
I see this porting simillar to the labor substitition.. Till it was in place it was legal although thousands bought labors and that is one main reason EB2 had retrogressed back to 2000. I predict simillar thing is happending again, people are paying money to the desi employers to file perm in EB2 again pretty soon same tertrogression will happen to EB2 I if any urgent action is not taken.

You can't compare porting with labor substitution. For porting, you have to go through the complete process and not just throw some dollars.
Same logic applies to people who say "I was eligible to file for EB2, but my employer/lawyer forced me to file on EB3".
It's the ignorance of process, if you are eligible for EB2 .. go join any other company.. it's America .. for God's sake..

EB2-India with May 2005 PD and before : All will be out before May 2010 with some residuals in NC. One thing I am sure, EB2/3-India with PD 2006 and afterwards should not start working on EAD and will have to hold on to H1.
PDs with 2006 and onwards - both for EB2/3 - Unpredictable and scary assuming no change in current immigration policies.

I felt the need to explain "why the over subscription and what part USCIS had in it" and also in the mean time point to the "overzealous work done by USCIS on June 30 and July 1st".
Sentence in the press release: However, due to over-subscription, thousands of highly-skilled workers, including engineers, scientists and health care professionals have been waiting patiently for years in order to be eligible to apply for their Green cards.
My take on this: Due to inefficiency of USCIS in the past years, 187,000+ visas have been wasted according to Ombudsman report. This act is to be blamed partly for the present scenario of over-subscription of thousands of law abiding and tax paying highly-skilled workers, including engineers, scientists and health care professionals who have been waiting patiently for years in order to be eligible to apply for their Green cards.
USCIS's sudden backlog reduction efforts during the past month have resulted in the use of almost 60,000 Employment numbers among which 18,000 were used on June 30 (Saturday) and July 1st (Sunday) according to (Quote source).

To change the interpretation of how spillover is applied, you will need a better argument than "The system isn't fair."
Why should the USCIS/DOS favor EB3 over EB1 or EB2? Unless you provide a reason that benefits America, no executive or law maker is going to touch this. You can see why this is a tough argument to make - The USCIS sees EB1 as better educated and more accomplished on average than EB2 and the same for EB2 over EB3. Are there exceptions to the rule? Ofcourse there are. But the law is designed to solve the most common scenario and not complicated situations like this.
EB3 to EB2 isn't a slam dunk as many of you have correctly pointed out. One option is to move employers and find the right employer who is ready to file for EB2. While that may not work for everyone, it is the only known way out of the EB3 nightmare.
I support measures that will alleviate your pain although this will likely not benefit my personal situation. Visa recapture is a real possibility at the end of this year - I recommend you support IV to accomplish this goal.

Ok that is funny. So I have been waiting for 6 years now here and that is nothing. some kid comes in here and struggles to complete his MS and then just works for 3 years and gets in line before me !!

I guess you do not have the slightest idea of the struggles and financial uncertainty of studying in the U.S. As a matter of fact THIS IS FAIR. Did you know that it cost over $20 K to go to school here just in tuition (with out any assistantship's, which is the norm for over 5 years now with the bad economy first and the lack of funding to graduate schools across the country) and most people who come on student visas gain experience through internships( on OPT's and CPT's) making as little as $10/ hour, not to mention working for minimum wages as they study to make ends meet and then and finally the effort of paying off student loans back home. Not only that a majority of people who come on F1 visas to U.S educational institutions pursue Advance degrees in not so "lucrative" fields in terms of job prospects like core engineering fields, pure sciences and many of them go on to get PhD and become researchers.
That is exactly what the U.S wants; they want the brain drain to resurface to bring about innovation in engineering and sciences. The only folks that come to work directly in the U.S are the IT folks so you are looking at a small spectrum of people. Again this is a long awaited gesture from U.S immigration system to people's trials and tribulations who take the long and winding road to pursue advance degrees in the U.S and eventually get on to work and enhance their professional goals.
