My wife was working for a company before. They had filed for her GC. She has an approved I140. She had to convert to H4 because of some legal reasons and could not continue to work for the company. Now she has a valid H4.
She has already been here 7 years on her old H1. Now can she file for a H4-H1 and get a 3 year visa based on an approved 140 ?
The lawyer says that the 3 year extension rule just states that H can be continued beyond 6 years based on approved 140 and so she can go back to a H1...
Anyone here has had a similiar experience ?

Pew confirms what we've already assumed is happening. The number of illegally present immigrants has dropped 8% since 2007. The number is now about 11 million, down from peaking at 12 million. The annual migration of illegally present immigrants has dropped from about 850,000 a year a few years ago to just 300,000 a year today. Why? Hi,
My husband and I work for a large MNC. We have our own L1's. Currently my husband's L1A is under processing. There is a RFE on it.
I want to know if we can change the status for him from L1 to L2 or to H1 without he having to leave the country?
If so what is the process to do it?
Can I apply for his L2 while his L1A is under processing?

Some big compromises in the House version that dropped this morning. First, there will be $2525 in filing fees, $525 of which is due at the outset and $2000 of which is paid five years in to the ten year conditional non-immigrant period. That should presumably answer critics who complain that DREAM will add to the deficity. Also, conditional status is granted in two five year terms and the college education/military service requirements must be met in the first five year term in order to get the extension approved. I think you have the wrong information. Senate is not ready to vote on it yet. S 2198 which is a part of PACE and holds relevance to the employment based immigration is still in committee hearings.

Perhaps there is a chance we'll see some action on the DREAM Act in 2011 albeit with some major tough to accept changes. The key areas likely to change are the education requirement (mandating actually receiving a degree versus simply attending school), the ability to sponsor relatives down the road when DREAM Act finally become citizens (at least 13 years out) and criminal bars on applying.

It is clearly stated in the I-485 instructions that parents should sign for children below 14 years of age. Those 14 and above should sign for themselves.
Do we need to sign the I-485 docs on behalf of minors? My daughter is 9 years old and she has signed her papers all by herself. When I asked my attorney, one time she said I need to sign and finally she sent the docs with her signature only.

Does anyone know answer to my question? GC processing for family based has preferences 1, 2A, 2B, 3, 4 and then employment based has EB1, EB2, EB3 and so on. In what sequence USCIS assigns GC to these categories taking into consideration per country 7% limit? For example, 1 GC to family 1, then 1 to family 2A, then 1 to emp EB1 etc (a hypothetical sequence). Any idea?

do you get a FP notice only if you file AP and EAD along with your 485 ?

As per my knowledge, You will be out of status if you didn't your H1B approval.
So you should try alternative things, like moving on to F1 or H4 dependent Visa.
If you have EAD you should not worry at all.
About USCIS, sometimes it won't get updated. One of my cousin's H1B was canelled and compant got confirmation mail, But still his status shown as active from past 1 year. Make sure with your Employer (ABC/initial company who has your h1B upto Feb-2011) that they got letter from USCIS.
